Terms of Use

1. Acceptance of Terms

By using the Jolene app or website, you agree to these Terms of Use. If you do not agree, please do not use Jolene.

2. Eligibility

You must be at least 16 years of age to use Jolene. By creating an account, you confirm that you are 16 or older.

3. Account Responsibilities

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and truthful information when creating your account and listings.

4. Prohibited Content

Jolene has zero tolerance for objectionable content or abusive users.

The following content and behaviour is strictly prohibited:

Counterfeit or fake items: All listings must be for genuine, authentic products.
Offensive content: No offensive, inappropriate, discriminatory, or illegal content.
Harassment: No harassment, bullying, threats, or abusive behaviour towards other users.
Spam: No spam, duplicate listings, or misleading descriptions.
Illegal items: No items that are illegal to sell under New Zealand law.
Stolen goods: No items that have been stolen or obtained illegally.
Dangerous goods: No weapons, explosives, drugs, or other dangerous items.

5. Reporting and Moderation

Users can report listings or other users that violate these terms by tapping the flag icon on any listing or seller profile.

Jolene will review and act on all reports within 24 hours. This may include removing content and permanently banning the offending user.

6. Blocking Users

You can block any user from their profile page. Blocking a user will hide their listings and messages from your feed. You can manage your blocked users list in Settings.

7. Enforcement

Jolene reserves the right to:

Remove any content that violates these terms without notice
Suspend or permanently ban users who violate these terms
Cooperate with law enforcement if required
Modify or remove listings that are misleading or inappropriate

8. Buying and Selling

Jolene facilitates transactions between buyers and sellers. When you list an item, you agree that the item is accurately described and in the stated condition. When you purchase an item, you agree to pay the listed price.

9. Payments

All payments are processed through Stripe. Jolene does not store your payment card details.

10. Shipping and Delivery

Sellers are responsible for shipping items promptly after a sale. Buyers and sellers can arrange local pickup as an alternative. Jolene is not responsible for lost or damaged parcels but will assist in resolving disputes.

11. Offers

Buyers can make offers on listings. Sellers can accept, decline, or counter offers. An accepted offer creates a binding agreement to complete the transaction.

12. Reviews

Buyers can leave reviews after completing a transaction. Reviews must be honest and fair. Jolene reserves the right to remove reviews that are abusive or fraudulent.

13. Intellectual Property

You retain ownership of content you post on Jolene. By posting content, you grant Jolene a licence to display and distribute that content within the app and for promotional purposes.

14. Limitation of Liability

Jolene provides the platform "as is" and is not liable for disputes between buyers and sellers, the quality or authenticity of items, loss or damage during shipping, or any indirect damages arising from use of the platform.

15. Privacy

Your use of Jolene is also governed by our Privacy Policy.

16. Changes to Terms

We may update these Terms of Use from time to time. Continued use of Jolene after changes constitutes acceptance of the updated terms.

17. Governing Law

These terms are governed by the laws of New Zealand.
